Terms of Participation in SiteGround 2022 Recap

I. General

1.1. These Terms of Participation (“Terms”) govern the terms and conditions for the game “SiteGround 2022 Recap” (“Game”).

1.2. The Organizer of the Game is SiteGround Spain S. L. (“SiteGround”), a company registered and existing under the laws of the Kingdom of Spain, with registered address: Calle de Prim 19, 28004 Madrid, Spain, with VAT: ESB87194171, CIF: B87194171, (“SiteGround” or “Organizer”).

1.3. The Game takes place from 15th of December, 2022 until 9th of January, 2023, 12 PM UTC+2 (“Game Period”).

1.4. The Game is organized and conducted in Spanish/Italian/German.

II. Right of participation

2.1. All individuals over 18 years old have the right of participation (“Participant(s)”). Employees of companies, part of SiteGround Group of companies and members of their families (parents, children, spouses and related parties) are not allowed to participate in the Game. Legal entities may not participate in the Game.

2.2. Participation in the Game is only possible in accordance with these Terms. By participating in the Game, the Participant explicitly agrees and accepts to comply with these Terms. The Terms will be available for the entire Game Period at: https://www.siteground.com/viewtos/2022_recap_terms.

III. Conditions for participation

3.1. In order to participate in the Game, the Participant must, within the Game Period (15th of December, 2022 until 9th of January, 2023, 12 PM UTC+2), visit the following webpage: siteground.com/2022, review the information about SiteGround year 2022 and fill out the relevant information about himself/herself in the mandatory fields required for this purpose: first and last name and email address. The Participant shall agree with the Terms of the Game, and shall press the button “Submit”. For every entry under p.3.1 for the prize draw, a unique email address shall be provided.

3.2. Individuals can also participate in the Game if, within the Game Period (15th of December, 2022 until 9th of January, 2023, 12 PM UTC+2), they share the information about SiteGround Year in Review 2022 (The Recap) via a public post or as a public story on social media (Twitter, Facebook or Instagram), using the appropriate button at the end of the webpage: siteground.com/2022 and quoting the following hashtag: „#siteground22”. As an additional requirement to participate through Instagram, you must comment on the post related to the Recap on Instagram before sharing it on story. Each sharing under the terms of this provision shall be considered a separate entry in the Game. Participants may share the Recap unlimited times.

IV. Prize

4.1. All individuals who fully complete the rules above will participate in a draw for the following prize: 1 (one) pair of Bose headphones, branded with the SiteGround logo.

4.2. If unable to ship the prize to your country, we will provide you with the equivalent in free hosting services. There is no substitution of a winning prize with its cash equivalent or another prize. The right to receive a winning prize cannot be transferred to third parties.

4.3. The draw shall be performed on January 10th, 2023, by using an independent third-party online drawing tool: https://www.random.org/draws/. Оn January 10th, 2023, SiteGround will contact the prize winner via email in case the winner has participated in accordance with art.3.1 or via а direct message on social media in case the winner has participated in accordance with art.3.2. Within 10 (ten) calendar days of receiving the notification, the winner must respond and provide a full name, shipping address and contact phone number, so SiteGround can ship the prize to the winner.

4.4. The prize winner shall follow any applicable requirements of their domicile tax jurisdiction, incl. but not limited to: declaring the prize won before tax authorities (if required by law) and payment of due taxes if such.

 V. Limitation of Liability

5.1. SiteGround is not responsible if the Participant has provided an incorrect email/shipping address, so SiteGround could not reward the Participant.

5.2. SiteGround may at any time amend and/or cancel these Terms, as such amendments and/or cancellation will be considered duly communicated with the participants by publishing them at: https://www.siteground.com/viewtos/2022_recap_terms. In these cases, SiteGround does not owe any compensation to the Participants.

5.3. All Participants take on their own responsibility for all costs incurred or likely to arise due to their participation in the Game.

5.4. Participants who do not comply with the Terms will be disqualified without further notice, losing the right to win a prize if they were entitled to such prize.

VI. Personal data

6.1. This Article 6 represents an official Privacy Policy which shall regulate the rights and obligations in regards to personal data being collected and processed for the purposes of the Game. Please review this Privacy Policy carefully before entering into the Game and should you have any questions and/or concerns relating to data privacy, do not hesitate to contact us at dpo@siteground.es.

6.2. The data required to participate in the Game will be processed according to these Terms and the Game Privacy Notice, available, as follows:

By registering for participation in the Game you agree that SiteGround (“Controller”) may process your personal data as a data controller.

Any personal data collected by SiteGround in connection with this Game will be used to administer and fulfill this Game. SiteGround will use information that entrants supply when entering the Game only in accordance with SiteGround’s Privacy Policy and these Terms. More specifically, the personal data needed to participate in the Game is first and last name, email address or social media username. The personal data needed to receive the prize is first and last name, email address or social media username, contact phone number and delivery address.

Processing of the data will be done solely for the purpose of carrying out and managing the Game, identification of the winner/s, singling out and contacting the winner/s and delivery of the prizes. The processing is necessary for the performance of a contract to which the individuals are a party by agreeing with the Terms of the Game.

The personal data provided by you will be stored for a term no longer than 6 (six) months and will be deleted after this. However, the information of the winner may be kept longer in order to comply with the applicable legal, accountancy and tax requirements. If necessary, SiteGround may share your data with third parties only when there is a valid legal basis for this and the necessary measures and guarantees have been taken to protect the confidentiality of your data.

These Terms are governed by the laws of the Kingdom of Spain.
